2. DEFINITIONS

2.1 Within this Contract:

  1. ‘Condition’ refers to the standard terms and conditions of sale outlined below, along with any special terms that have been mutually agreed upon in writing;
  2. ‘Contract’ denotes any agreement made between you and the Company for the supply of Goods;
  3. ‘Goods’ represent the products we will provide in accordance with these Conditions;
  4. ‘Order Confirmation’ signifies the acknowledgment that your order has been received, accepted, and will be dispatched upon successful payment;
  5. ‘We’ refers to Casa/ Casa Di Stone, also known as the ‘Company’, which is the trading name of Casa Di Stone Ltd, with its registered office at 59-61 Charlotte Street, St Pauls Square, Birmingham, United Kingdom, B3 1PX and Company number: 16106749.

  1. ‘You’ refers to the customer purchasing Goods from us, and ‘Your’ shall be interpreted accordingly.

3. ELIGIBILITY TO PURCHASE GOODS

3.1 All products listed on our website are available for sale globally.

3.2 If you are ordering for delivery outside the UK, please contact us via phone or email to confirm whether we can deliver to your location before proceeding with your order.

3.3 By placing an order, you confirm that you have the legal authority and necessary permissions to enter into this Contract.

3.4 When registering for an account, you must keep your login details secure. You must inform us immediately if you suspect unauthorised use of your account. 

3.5 We strongly recommend that you do not schedule any installation until you have received and inspected your entire order.

3.6 Casa Di Stone is not responsible for any third-party contractor or installer costs if a delay or issue arises.

3.7 Customers are responsible for checking access requirements before attempting delivery. We bear no responsibility for any damage incurred while manoeuvring goods into position.

3.8 Any changes to product lead times after a proforma invoice has been issued and paid for are beyond our control. However, we will make every effort to keep you informed.

3.9 Casa Di Stone reserves the right to suspend or terminate accounts if fraudulent or suspicious activity is detected. 

4. PRICING

4.1 The price of Goods is determined at the time of placing the order and confirmed on your invoice.

4.2 Prices are quoted in UK Pounds Sterling. Unless other countries/ currencies are selected on site. At which point those prices are relevant for delivery to those countries/locations. 

4.3 Delivery costs are not included in the product price and will be added separately as outlined in our Delivery Guide and these will vary on item size and location globally. 

4.4 The price of Goods includes VAT at the prevailing rate for UK customers. For global customers the VAT will be removed and Customers outside the UK are responsible for paying any import duties, VAT, or other local taxes upon delivery. Casa Di Stone will not be liable for additional fees incurred upon customs clearance.

4.5 Prices are subject to change; however, confirmed orders will not be affected.

4.6 In cases of pricing errors, we will verify the correct amount before dispatch. If a correction is required, we may seek your confirmation or reject the order and notify you accordingly.

5. ORDERS & ACCEPTANCE

  1. Orders can be placed via our website or through our sales team.
  2. When an order is placed, an initial confirmation email is sent. This is not an order acceptance. We will confirm stock availability, process payment, and issue an Order Acceptance Email.
  3. If an item is out of stock, we will notify you with alternative options, provide estimated lead times, or issue a full refund. If you prefer to wait for restocking rather than receiving a refund, you may request to keep your order open until the item becomes available.
  4. Casa Di Stone reserves the right to decline any order at our discretion.
  5. Full payment is required at the time of ordering. We do not offer credit terms unless agreed separately. Orders will only be processed once payment has cleared. If a payment fails, the order will be automatically cancelled.
  6. If there are any issues with the details you provided (e.g., incorrect delivery address), we will attempt to contact you. However, if we cannot reach you, the order may be cancelled. 
  7. If you need to change or cancel your order, please contact Customerservice@CasaDiStone.com immediately. If the order has not yet been processed for dispatch, we may be able to make changes. However, once an order has been shipped, we cannot modify or cancel it.
  8. Fraud Prevention- We have security checks in place for fraud prevention. If we detect unusual activity or suspect fraudulent use of payment details, we reserve the right to cancel the order without prior notice. If your order is flagged for review, we may contact you for additional verification. If we do not receive a response within 48 hours, the order will be cancelled and refunded.

6. CANCELLATION RIGHTS

6.1 You may cancel the Contract in the following circumstances:

6.1.a. For internet, telephone, and store/in person orders where goods have not been installed, you may return Goods within 14 days of receipt if you are dissatisfied for any reason. Delivery fees and a maximum of 20% restocking fee for all non-faulty returns may at our discretion apply based on the product condition, packaging status and administrative costs. 

6.1.b. If the Goods received are faulty or do not match the specifications of your order.

6.2 You must notify us of your intent to cancel in writing via email to customerservice@CasaDiStone.com within 14 working days of receipt of the Goods.

6.3 Goods must be returned in an unused, uninstalled condition, with all original packaging, labels, and protective covers intact, at your own cost, within 21 days of cancellation.

6.4 A refund will be processed within 14 days of cancellation and once goods have been received back and checked.

7. BESPOKE ORDERS

7.1 Goods made to measure based on customer-provided specifications or measurements are non-returnable unless faulty.

7.2 If you require a size that is not listed on our website, please contact us for assistance.

7.3 Given the handcrafted nature of our products, minor design modifications or size adjustments may be requested and there is always a margin of error allowable with all products. 

7.4 For bespoke orders, a technical drawing will be provided for your review. Production will only commence once you approve and sign off on the drawing

  1. SHIPPING & RECEIVING ORDERS 
  1. Bath Deliveries- All freestanding baths are delivered using specialist transport to ensure they arrive in perfect condition. Customers must ensure adequate access for delivery. For further details please refer to our delivery and returns customer information for requirements for delivery. 
  2. Baths must be inspected upon delivery. Once the item has been moved beyond the initial delivery point (e.g., curbside, threshold), Casa Di Stone accepts no liability for damage. Customers are responsible for ensuring safe handling beyond this point. 
  3. It is the customers responsibility to check delivery requirements. 
  4. Someone must be present to accept delivery and inspect the bath upon arrival. If damage is noticed upon delivery, it must be reported immediately to the driver and noted on the delivery paperwork.
  5. If a failed delivery occurs due to access issues, re-delivery charges will apply.
  6. It is your responsibility to ensure the delivery address is correct; incorrect details may lead to additional charges.
  7. Goods must be checked upon delivery, and any damages reported within 48 hours via email to Customerservice@CasaDiStone.com with accompanying photographic evidence and a description of the issue.

9. RETURNS POLICY - DEFECTIVE OR INCORRECT GOODS

9.1 Goods must be inspected within 48 hours of delivery. If there are any discrepancies, they should be reported immediately.

9.2 If the Goods are faulty or incorrect, we will arrange for a replacement or return in accordance with our policy.

10. GUARANTEES & PRODUCT ISSUES

  1. Lifetime Guarantee: Casa Di Stone offers a lifetime guarantee on all stone resin products, covering the intended reasonable lifespan of the goods under normal use. This guarantee covers manufacturing defects, structural integrity, and material consistency.
  2. The guarantee applies only to the original purchaser and is non-transferable.
  3. The guarantee is valid only when the product has been installed and maintained according to our guidelines.
  4. The guarantee does not cover:
  • Damage caused by misuse, neglect, or impact damage.
  • Inappropriate cleaning methods, including the use of harsh chemicals, bleach, or abrasive materials.
  • Limescale build up, corrosion, mould, mildew, or stains caused by improper maintenance.
  • Damage resulting from external environmental factors such as extreme temperature fluctuations or excessive moisture exposure.
  • Normal wear and tear, including surface scratches, slight discoloration, or changes in texture over time.
  • Any unauthorised modifications, repairs, or alterations.
  1. Proof of purchase is required for any warranty claim.
  2. If a valid warranty claim is approved, Casa Di Stone may repair, replace, or refund the product at its discretion. The decision will be based on the extent of the defect, product availability, and feasibility of repair. If repair is not possible, a replacement of the same or equivalent product will be offered. In cases where neither repair nor replacement is feasible, a refund will be issued in accordance with the product’s original purchase price excluding any shipping costs.
  3. Casa Di Stone reserves the right to inspect the product before approving a warranty claim and may request photographic or physical evidence of the defect before proceeding with any resolution.
  4. The decision of Casa Di Stone regarding warranty claims is final.
  5. To make a warranty claim, you must contact Casa Di Stone at Customerservice@CasaDiStone.com within 14 days of identifying an issue.
  • You must provide:
    • Proof of purchase (receipt or invoice).
    • Photographic evidence showing the defect.
    • A detailed description of the issue.
  • Casa Di Stone reserves the right to request additional information or an inspection of the product before approving a claim.
